Terms of service

These Terms of Service (the “Terms”) set out the conditions governing use of the online store operated by TC Japan Inc. (the “Company,” “we,” “us,” or “our”) and its related services (collectively, the “Service”).

These Terms of Service apply to customers in the United Kingdom who use our online store.

Article 1 (Application)

  1. These Terms apply to all customers who use the Service.
  2. The guides, policies, and individual conditions stated on product pages that we publish on this website form part of these Terms.
  3. If these Terms conflict with any individual conditions, the individual conditions will prevail.

Article 2 (Orders and Formation of the Sales Contract)

  1. When a customer completes the checkout process, the customer submits an offer to purchase the product from us.
  2. An automatically generated order-confirmation email only confirms receipt of the offer and does not constitute notice that a sales contract has been formed.
  3. The sales contract is formed when we send the shipping confirmation.
  4. If we cannot accept an order, we will contact the customer. If payment has already been received, we will issue a refund using our prescribed method.

Article 3 (Product Information)

  1. The sales price, condition, actual measurements, included accessories, quantity available, and other individual conditions are stated on each product page.
  2. Our products include pre-owned items. Please review the actual product photographs, videos, and descriptions on the product page for information concerning age-related changes and characteristics inherent to the materials.
  3. Colors may appear different from the actual product due to screen settings or the photographic environment.

Article 4 (Payment)

  1. Payment methods, payment timing, fees, and other conditions are stated during checkout and on our Payment Methods page.
  2. For bank transfers, payment must be made by the deadline stated on the invoice we provide. If payment is not confirmed by the deadline, we may cancel the order.
  3. The terms established by the relevant provider apply to the use of cards and other payment services.

Article 5 (Shipping)

  1. Shipping charges, dispatch timing, shipping methods, customs duties, import taxes, and other conditions are stated on our Shipping, Delivery & Item Holds page.
  2. Delivery may be delayed due to weather, traffic, customs clearance, circumstances affecting the carrier, or other unavoidable reasons.
  3. If reshipment is required because of an incorrect shipping address provided by the customer, the customer’s absence, expiration of the collection period, or another circumstance attributable to the customer, the customer is responsible for the resulting costs.

Article 6 (Cancellations, Returns, and Exchanges)

  1. After the customer completes the checkout process, cancellations, returns, or exchanges for reasons attributable to the customer are generally not accepted, including before the sales contract is formed.
  2. The deadline for contacting us, return conditions, and refund conditions when a delivered product differs from its product-page description are stated on our Returns & Exchanges page.
  3. The provisions concerning cancellations, returns, and exchanges stated in our Disclosures under the Act on Specified Commercial Transactions and the Secondhand Goods Business Act also form part of these Terms.

Article 7 (Refusal or Cancellation of Orders by Us)

If any of the following applies, we may decline an order before the sales contract is formed or, after formation, take necessary action within the scope of applicable laws and these Terms, including cancelling the order, terminating the contract, or restricting use of the Service:

  1. Payment cannot be confirmed by the payment deadline
  2. Registration or order information is false, incomplete, or incorrect, or we are unable to contact the customer
  3. Fraudulent use of a card or other payment method, impersonation by a third party, or other misconduct is suspected
  4. The product cannot be supplied because of an inventory discrepancy, a material change in its condition identified during inspection before dispatch, or another unavoidable circumstance
  5. The customer has violated these Terms or any conditions stated on this website
  6. There is another reasonable basis that makes fulfillment of the order or proper operation of the Service difficult

If we cancel an order or terminate a contract after receiving payment, we will issue a refund using our prescribed method.

Article 8 (Account Management)

  1. Customers must keep their registration information accurate and up to date and manage their accounts and passwords appropriately.
  2. Accounts may not be transferred, lent, or shared with a third party.
  3. If a customer becomes aware of unauthorized use by a third party, the customer must contact us promptly.

Article 9 (Prohibited Conduct)

Customers must not engage in any of the following conduct when using the Service:

  1. Conduct that violates laws, regulations, or public order and morals
  2. Registering or submitting false information
  3. Unauthorized use of cards, accounts, or other payment or authentication methods
  4. Impersonating us or a third party
  5. Interfering with the operation of the Service, servers, or networks
  6. Infringing our or a third party’s copyrights, trademark rights, privacy, or other rights
  7. Causing disadvantage, loss, damage, or nuisance to us or a third party
  8. Providing benefits to or otherwise becoming involved with antisocial forces
  9. Other conduct that is inappropriate in light of the purpose of the Service

Article 10 (Suspension or Modification of the Service)

We may suspend, modify, or discontinue all or part of the Service due to system maintenance, communication failures, disasters, or other unavoidable reasons. When advance notice is possible, we will provide notice on this website or through another appropriate method.

Article 11 (Intellectual Property and Trademarks)

  1. Rights in the text, images, designs, and other content on this website belong to us or their lawful rights holders.
  2. CHANEL and all other trademarks and brand names belong to their respective owners. We are an independent retailer, are not an authorized CHANEL retailer, and are not affiliated with, endorsed by, sponsored by, or otherwise connected with CHANEL.

Article 12 (Liability)

  1. We provide the Service in accordance with the conditions stated on product pages and our information pages.
  2. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the Consumer Contract Act or other applicable laws.

Article 13 (Personal Information)

We handle personal information obtained through use of the Service in accordance with our Privacy Policy.

Article 14 (Changes to These Terms)

We may amend these Terms when an amendment conforms to the general interests of customers or when the necessity and substance of the amendment are reasonable. When making an amendment, we will announce the details of the amendment and its effective date on this website or through another appropriate method.

Article 15 (Notices and Communications)

Notices and communications between customers and us will be made through this website, the registered email address, or another method specified by us. If registered information changes, customers must promptly update it or contact us.

Article 16 (Assignment of Rights and Obligations)

Customers may not assign or pledge their status, rights, or obligations under these Terms to any third party without our prior written consent.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms are governed by and construed in accordance with the laws of Japan.
  2. The Tokyo District Court or Tokyo Summary Court will have exclusive jurisdiction as the court of first instance over any dispute arising in connection with the Service, except where otherwise provided by applicable law.
